Ms. Sharda Kumari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-09-2025 Heard learned counsel appearing on behalf of the petitioners and learned APP appearing on behalf of the State.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 109, 329(3), 76, 303(2), 352, 351(2) and 3(5) of the B.N.S..
3. As per prosecution case, informant, namely Laxmi Devi, alleged that on 28.03.2025, all the F.I.R. named accused persons, including these petitioners, variously armed, forcibly
Patna High Court CR. MISC. No.61805 of 2025(2) dt.09-09-2025 2/3 entered into house of informant and assaulted her and her family members. It is further alleged that the accused persons looted household articles.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. As a matter of fact, informant is none else than own Bhabhi (elder sister-in-law) of Petitioner Nos. 3 and 4 and Petitioner Nos. 1, 2 and 5 are also relatives. On account of petty family feud, this false and concocted case has been lodged. Allegation of assault is general and omnibus and no specific accusation of overt act has been alleged against these petitioners. Rest of the allegations are ornamental in order to make the case grave. It is further submitted that during pendency of this case, due to intervention of well wishers of the parties, the dispute has already been settled and a joint compromise petition has also been filed before the learned trial court on 25.06.2025. Petitioners claim clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the facts and circumstances of the case, relationship between the parties, general and omnibus
Patna High Court CR. MISC. No.61805 of 2025(2) dt.09-09-2025 3/3 nature of accusation, subsequent developments and clean antecedents of the petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Purnia in connection with Amour P.S. Case No. 131 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S.. (Prabhat Kumar Singh, J) shashank/- U T
