This is the second application on behalf of the petitioner for grant of anticipatory bail in connection with Hajipur Town Police Station Case No. 218 of 2019, disclosing offences under Sections 341/323/379/307/504/506/34 of the Indian Penal Code.
Earlier, the prayer for grant of anticipatory bail on behalf of the petitioner was rejected by order, dated 16.07.2019, passed in Criminal Misc. No. 43417 of 2019.
Learned Counsel for the petitioner submits that the
Patna High Court CR. MISC. No.61705 of 2019(2) dt.16-10-2019 2/2 Advocate of the petitioner had sought an information under Right to Information Act from the Indira Gandhi Institute of Medical Sciences, Sheikhpura, Patna, and the concerned authority has informed that no doctor, in the name of Dr. Balbir Singh, is working or posted in the Indira Gandhi Institute of Medical Sciences, Sheikhpura, Patna, whose report was shown to the Court at the time of rejection o the bail application. On the other hand, learned Counsel for the informant, referring to the case diary, submits that in fact the injury report of the victim was prepared by one Dr. Amlesh Kumar, and not Dr. Balbir Singh.
Having regard to the submissions made on behalf of the parties, I am not inclined to entertain this second application for grant of anticipatory bail to the petitioner. This application is accordingly dismissed.
