The petitioner seeks bail in a case registered for the offence under Sections 147, 148, 149, 341, 448, 323, 302, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, on 07.11.2019 at about 11:30 PM, petitioner and one Sunil Kumar entered in the house of informant and opened fire on his father, as a result of which, father of informant died on the spot.

It is submitted on behalf of petitioner that though, there is allegation of firing against petitioner and one coaccused, but only two injuries have been found on the person of deceased, one is entry wound and the other is exit wound. Petitioner claims clean antecedent and he is in custody since 14.06.2021.

No.1000 of 2022(3) dt.26-04-2022 2/2 However, learned counsel for the State and Informant opposed the bail petition and submitted that bail petition of similarly situated co-accused Sunil Kumar has already been rejected by this Court, vide order dated 25.06.2021 passed in Cr.Misc. No. 12107 of 2021.

Considering the nature of accusation and the fact that bail petition of similarly situated co-accused has already been rejected, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
