2. In the present case, the petitioner seeks bail in connection with Kalyanpur P.S. Case No. 279 of 2024 registered for the offences under Sections 25(1-b)a, 26 and 35 of the Arms Act.
3. As per prosecution case, police received informant about suspicious activities of two persons. A raid was conducted and one of them was apprehended and another miscreant fled away from the spot. From the apprehended co-accused, recovery of a country made katta and one live cartridge was made. The apprehended co-accused Ayush Kumar named this petitioner who fled away from the spot.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been
Patna High Court CR. MISC. No.62095 of 2025(2) dt.10-09-2025 2/3 falsely implicated in this case. No material has come on record to shows the involvement of the petitioner in the offence as alleged. Nothing incriminating has been recovered from the person or possession of this petitioner and merely on the basis of confessional statement of co-accused Ayush Kumar, the petitioner has been made accused in this case. Even recovery of country made katta was made from co-accused and not from this petitioner. Petitioner is having antecedent of three cases and in two such cases he is on bail. Petitioner is in custody since 18.06.2025 and charge-sheet has been submitted.
5. Learned A.P.P. opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the remoteness of allegation against the petitioner which appears to be doubtful and also considering the period of custody of the petitioner and submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Motihari, East Champaran/ concerned court in connection with Kalyanpur P.S. Case No.
Patna High Court CR. MISC. No.62095 of 2025(2) dt.10-09-2025 3/3 279 of 2024, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
