2. The petitioners have preferred this application for grant of regular bail in connection with Sasaram Muffasil P.S. Case No. 295 of 2024 dated 04.07.2024 registered for the offences punishable under sections 108, 61(2) read with Section 3(5) of the B.N.S.
3. As per the prosecution case, the informant alleged that her husband was in depression on account of non payment of the dues relating to the services provided by her husband as well as electrical articles having been supplied by him to several

It is further alleged that when her husband asked for his money, the petitioners and other accused persons abused him due to which on 02.07.2024 the husband of the informant committed suicide on the railway line. Accordingly the FIR has been lodged against the petitioners.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioners have never taken loan from the deceased but the deceased has done some electricity work in the house of the petitioners and for that the payment was done immediately to the deceased after the work got completed. It is further submitted that the alleged offence of abetment to commit suicide is not made out against the petitioners in view of the allegations made in the FIR, according to the informant. Nothing has been recovered from the conscious possession of the petitioners. The occurrence took place on 02.07.2024 but the FIR was lodged on 04.07.2024 i.e. a delay of two days and there is no explanation for this delay. The petitioners have no concern with the alleged occurrence. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 16.07.2025. The co-accused person has already been granted anticipatory bail by
Patna High Court CR. MISC. No.63025 of 2025(2) dt.16-09-2025 3/3 the Co-ordinate Bench of this Court vide order dated 29.01.2025 passed in Cr. Misc. No. 74101 of 2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Rohtas, in connection with Sasaram Muffasil P.S. Case No. 295 of 2024.
7. The application stands allowed.
