ANJANA MISHRA ORAL ORDER 13-09-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 22.07.2019 in connection with Case No. C2/457 of 2019 registered for the offence under Section 30 (a) of the Bihar Prohibition & Excise Act, 2016.
Learned counsel for the petitioners submits that the alleged recoveries were not made from the conscious possession of the petitioners but from near BP No. 343/2 between Nepal and India where the petitioners were found to be present. It is further submitted that petitioners have no criminal antecedents. Considering the aforementioned facts and
