Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in connection with Barun P.S. Case No. 422 of 2022 registered under Sections 379, 411 of the Indian Penal Code and M.M.D.R. Act, 1957, Rule 4(1-A) 21 Bihar Minerals (Concession Prevention of Illegal Mining Transportation and Storage) Rules 2019 of 11, 18, 43 and 2021 Rule 56.

Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case on mere suspicion. Further submission is that similarly situated co-accused persons have

Patna High Court CR. MISC. No.63472 of 2023(2) dt.17-10-2023 2/2 already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 16.08.2023 passed in Cr. Misc. No. 50247 of 2023.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 422 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
