The petitioners apprehend their arrest in Kesariya P.S. Case No. 263 of 2014 registered for the offences under section 307 and other sections of the IPC.
The informant named the petitioners and alleged that they assaulted the informant and his wife.
Learned counsel for the petitioners submits that on account of land dispute the occurrence took place. There is
Patna High Court Cr.Misc. No.10863 of 2017 (4) dt.18-04-2017 counter version being Kesariya P.S. Case No. 264 of 2014. No body got any visible injury. The Superintendent of Police, East Champaran, Motihari reported to this Court vide letter no. 931 that the informant did not receive any injury and he did not get admitted to any hospital.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateXI, Motihari, East Champaran in Kesariya P.S. Case No. 263 of 2014, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
