Petitioner is in custody in connection with Excise Case No. 2142/2018 arising out of Shahpur (Bahoranpur O.P.) P.S. Case No. 361/2018 for the alleged offence under Section 30(a) of the Bihar Prohibition and Excise Act. Allegation against the petitioner is that 43.200 liters of English wine was recovered from the possession of the petitioner. Learned counsel representing the petitioner submits that the petitioner is in custody since 25.11.2018. He further submits that the petitioner has no criminal antecedent and has been falsely implicated in the instant case.

Considering the totality of the facts and circumstances of the case, let the petitioner above named, be released on bail

Patna High Court Cr.Misc. No.79592 of 2018(2) dt.11-01-2019 2/2 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Bhojpur (Ara) in connection with Shahpur (Bahoranpur O.P.) PS Case No. 361 of 2018.
