The petitioner has preferred this application for grant of regular bail in a case registered under sections 306 and 34 of the Indian Penal Code.

As per the prosecution case, it is stated that the three accused persons including the petitioner herein proceeded to the house of the informant. It is stated that the accused said that they would not spare the husband of the informant, as he had caught hold of Lakhiya Devi and he would not be permitted to live. It is further stated that as a result of the said incidence on 15.3.2021, on 18.3.2021, the husband of the informant committed suicide by consuming poison. The cause of suicide is the threats given by the accused persons.

Patna High Court CR. MISC. No.72308 of 2021(2) dt.07-06-2022 2/2 It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No overt act has been alleged against her in the F.I.R. The husband of the petitioner has been enlarged on bail vide order dated 26.4.2022 passed in Cr. Misc. no. 66784 of 2021. The petitioner is in custody since 17.9.2021 and investigation in the case is complete.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the F.I.R, the petitioner being a lady having remained in custody for 8 months and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Chutiya P.S. Case no.16 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Dehri-on-Sone, District Rohtas.
