JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2019 This application, for grant of anticipatory bail, arises out of Turakauliya (Raghunathpur) P.S. Case No. 196/17, disclosing offences under Sections 399, 402, 379, 411 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.

Allegation as per F.I.R. is that, the police on information that some persons are making planning to commit dacoity in an under construction house, raided the place of occurrence and arrested two persons and on search one country made pistol was recovered.

Submission of learned counsel for the petitioners is that he has falsely been implicated in this case and he was not present there further he is an armed force personnel and the

Patna High Court CR. MISC. No.79351 of 2018(3) dt.25-02-2019 2/2 house and the recovery was made from an under constructed house. Further he is ready to abide by any condition imposed on him for grant of bail.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Turakauliya (Raghunathpur) P.S. Case No. 196/17, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
