JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2017 The petitioner is apprehending his arrest in connection with Harnaut P.S. Case No. 222 of 2016 registered for offences punishable under Sections 384, 406, 420, 467, 468, and 469 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that apart from this case, three more cases have been filed by the informant with respect to the same occurrence and even according to the First Information Report, three partners were running a Hero Honda Showroom and due to bouncing of the cheque, other cases have been lodged against the petitioner. Heard learned A.P.P. also. Learned counsel for the informant has opposed the prayer for bail.

Having heard both sides and in view of the fact that

No.8986 of 2017 (3) dt.06-03-2017 2/2 total four cases have been lodged with respect to the dispute that three partners were running a Hero Honda Showroom, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 50,000 (Rs. Fifty Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Biharsharif Nalanda in connection with Harnaut P.S. Case No. 222 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. This is further subject to the condition that the petitioner shall cooperate in the investigation of the case and make himself available before the police as and when required and in the event of failure on his part to appear before the police on two consecutive occasions, his bail bond shall be liable to be cancelled.
