JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-02-2017 Heard learned counsel for the petitioner, and the learned counsel representing the State.

The petitioner apprehends his arrest in connection with Shahkund (Sajour) P.S Case No. 176 of 2016 registered for the offences punishable under Sections 341, 323, 448, 307 and 504/34 of the Indian Penal Code.

Allegedly, The petitioner and co-accused threw bricks upon the informant, causing head and finger injuries and further the petitioner caused threats to kill. Submission is of false implication and that the wife of the petitioner has been allowed pre-arrest bail by another coordinate Bench of this Court vide order dated 25.01.2017 passed in Criminal Miscellaneous No. 3075 of 2017. Learned A.P.P. opposes the prayer of pre-arrest bail by submitting that injury was found on the head. In the facts and circumstances stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of the order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Shahkund (Sajour) P.S. Case No. 176 of 2016 subject to the conditions as laid down in Section 438(2) of the Cr.P.C.
