====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 07-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Sheosagar (Baddi) P.S. Case No. 167 of 2016 instituted for the offence under sections 341, 323, 342, 365, 506 of the Indian Penal Code and 13, 17, 20 of the U.A.P.A. Act.

It is alleged that the petitioner is not named in the F.I.R. His name has come in the confessional statement of coaccused Bijay Rajbhar during investigation. From the written report, it appears that a threat call was received by the informant on his mobile, making demand to stop work. The caller disclosed his name as Rakesh Mishra, a member of T.P.C. It is further submitted that the informant received a call from his Munsi that 10-15 unknown accused has

Patna High Court Cr.Misc. No.7065 of 2017 (3) dt.07-03-2017 2/2 kidnapped the driver of the doctor namely, Dharmendra Paswan. From the written report itself, it appears that the petitioner is not named in the F.I.R.

From the order of learned Sessions Judge, it appears that his name has appeared in para-30, in the confessional statement of co-accused Bijay Rajbhar.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Sheosaar (Baddi) P.S. Case No. 167 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, subject to the conditions as laid down under Section 438(2) Cr.P.C.
