The petitioner is in custody in connection with Special Case No. 10913 of 2018, arising out of Masaurhi P.S. Case No. 860 of 2018 for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 17.11.2018. He further submits that in the instant case 9.50 litres of foreign liquor was seized from the house of the petitioner. He submits that the liquor has been seized from the joint house and not from the exclusive possession of the petitioner.

Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to

Patna High Court Cr.Misc. No.1243 of 2019(2) dt.28-01-2019 2/2 be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in connection with Special Case No. 10913 of 2018, arising out of Masaurhi P.S. Case No. 860 of 2018.
