The petitioner apprehends his arrest in Bodh Gaya P.S. Case No. 439 of 2020, registered for the offences punishable under Sections 354, 354(A), 379 and other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner chased the informant while he was going along with his wife on scooty, misbehaved with them and also assaulted the informant. It further alleged that petitioner snatched gold chain of informant. It is submitted that petitioner has been falsely implicated in this case. As a matter of fact, husband of informant dashed his scooty with the car of petitioner due to which sustained injury when the car of the petitioner was parked

Patna High Court CR. MISC. No.72238 of 2021(3) dt.08-08-2022 2/2 near the gate of Maya Sarovar Park and thereafter, informant started quarreling and marpit with the petitioner. No case under Section 354, 379 is made out against the petitioner. Snatching of ornaments is superfluous.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case No. 439 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
