====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 10-09-2025 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Tarabari P.S. Case No. 37 of 2025 dated 10.05.2025 registered for the offences punishable under Sections 80 read with Section 3(5) of the B.N.S.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have killed the informant's daughter due to non-fulfillment of demand of motorcycle and mobile as dowry.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.60747 of 2025(2) dt.10-09-2025 2/3 that the petitioner has falsely been implicated in this case. There is general and omnibus allegation against the petitioner, who is the maternal father-in-law of the deceased. The petitioner neither demanded any dowry nor tortured the deceased. The petitioner has four criminal antecedents in which he is on bail in all cases as stated in para 3 of the bail petition. The petitioner is in custody in this case since 17.05.2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for regular bail of the petitioner and submitted that the cause of death is due to asphyxia as a result of hanging. It is further submitted that the death of the deceased was committed within one month of her marriage. It is further submitted that as per para nos. 3, 4, 13 and 14 of the case diary, which is mentioned in the impugned order dated 30.07.2025, all the witnesses have supported the case of the prosecution.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Araria in connection with Tarabari P.S. Case No. 37 of 2025.
