JUSTICE BIRENDRA KUMAR ORAL ORDER 18-05-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 3(a) of the RP (UP) Act.
A prosecution report was submitted for the offence of theft of railway article wherein names of the petitioners have transpired in the confessional statement of co-accused. Submission is that the petitioners have got no criminal antecedent and nothing was recovered from the possession of the petitioners.
Considering the aforesaid facts, let the petitioners,
Patna High Court Cr.Misc. No.8339 of 2017 (5) dt.18-05-2017 above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Railway, Bhagalpur/Successor Court in connection with G.R.P. Post Kahalgaon Case No.02/16 (G.R.P.S. Case No.04/16), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and subject to the further condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioners in this case.
