The petitioners seek anticipatory bail in a case instituted for the offence under Sections 302, 201 and 34 of the Indian Penal Code.
As per allegation in the written report, the informant had gone for call of nature leaving her four months old daughter and when she returned she found her daughter was missing and, thereafter, she made search. The younger dewar of the informant Deepak Yadav brought the dead body of her daughter from a ditch near hand-pump. The informant has raised suspicion that these petitioners and other accused persons have caused death of her
Patna High Court Cr.Misc. No.3648 of 2017 (2) dt.10-02-2017 2/2 infant daughter on account of strained relationship. These petitioners are said to be parents-in-law of the informant. There is no allegation of any overt act against the petitioners. Considering the facts and circumstances of the case, let the petitioners above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Biraul P.S. Case No. 346 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Biraul (Darbhanga), subject to the conditions as laid down under Section 438 (2) Cr. P.C.
