JUSTICE SANJAY PRIYA ORAL ORDER 23-02-2017 Heard learned counsel for the petitioners and the State.

The petitioners apprehend their arrest in Gaurichak P.S. Case No. 193 of 2016 instituted for the offence under Sections 341, 342, 323, 324, 307, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

It has been submitted that petitioner no.1 is order giver. There is no any allegation of overt act against the petitioner no.3.

From the written report, it appears that on order of petitioner no.1, Sanjeet Singh (petitioner no.2) assaulted the

Patna High Court Cr.Misc. No.7877 of 2017 (2) dt.23-02-2017 2/2 informant by butt of gun on his nose.

Counsel for the petitioners has submitted that there is a case and counter case. The Photo copy of injury report has been annexed as Annexure-3, in which doctor has opined that injury no.1 is grievous in nature.

In such circumstances, since the injury no.1 is grievous in nature, this court is not inclined to grant anticipatory bail to petitioner no.2, namely, Sanjeet Singh. Accordingly, the prayer for anticipatory bail of petitioner no.2 is hereby rejected. So far as petitioner no.1 and 3 are concerned, there is no allegation against these petitioners. In the circumstances, prayer of the petitioner nos.1 and 3 for anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, namely, Satyajeet Singh and Kundan Singh, within six weeks from today in connection with Gaurichak P.S. Case No. 193 of 2016, they shall be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Patna City, Patna, subject to the conditions as laid down under Section 438(2) Cr.P.C.
