2. The petitioner apprehends his arrest in a case registered for the offence under Sections 109, 3(5) of the B.N.S. and Section 27 of the Arms Act and later on, Section 103 of B.N.S. was added.
3. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of the petitioner transpired during course of investigation on the basis of confessional statement of co-accused Gaurav Kumar. Only material, which has come against petitioner, is that the fire-arm, which was used in the alleged occurrence was taken from this petitioner and after the occurrence, it was again handed over to him for its safe custody. However, no incriminating article has been recovered from the house of this petitioner. There is absolutely no allegation that this petitioner participated in the
Patna High Court CR. MISC. No.62138 of 2025(2) dt.11-09-2025 2/2 alleged occurrence. Petitioner claims clean antecedent.
4. Learned A.P.P. for the State has opposed the bail petition.
5. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Patna in connection with Ramkrishna Nagar P.S. Case No. 784 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) anay U T
