The petitioner seeks anticipatory bail in a case instituted for the offence under Section 380 of the Indian Penal Code.

It has been submitted that the name of the petitioner has been disclosed by co-accused Yogesh Musahar who was caught on the spot. There is no recovery of any incriminating article from the possession of the petitioner. The petitioner has not been named in the written report rather the apprehended accused Yogesh Musahar has named him. The petitioner has clean antecedent which is apparent from paragraph-3 of the bail petition. Case No. 51 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
