The petitioner seeks bail in connection with Vaishali P. S. Case No.236 of 2021, instituted for the offences under Sections 413, 414 of the Indian Penal Code and Sections 30(a) 41 (I) of the Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 09.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of 100 litre of liquor from a sack alleged to be carried by the accused persons on a motorcycle.

The learned counsel for the petitioner submits that the

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur in connection with Vaishali P. S. Case No.236 of 2021.

The application stands allowed.
