JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-03-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Manigachhi P.S. Case No.134 of 2016, registered for the offences punishable under Sections 409, 420/34 of the Indian Penal Code.

Allegedly, the petitioner did not deposit folder and other register related to appointment of teachers of Brahmpur and Maunbehat of the year 2006.

Submission is of false implication and that the petitioner was transferred and he has already given all the charge including charge of the register of teacher appointment to Gulab Singh on 30.07.2011 itself which is evident from charge report

Patna High Court Cr.Misc. No.10307 of 2017 (2) dt.16-03-2017 2/2 and, as such, Gulab Singh is responsible for depositing the folder and other related document regarding the payment of teaches but surprisingly the petitioner has been made accused, resulting, he is apprehending his arrest.

The learned A.P.P. after going through Annexure-2 fairly submits that in Annexure-2 charge of teacher appointment register and other related document has already been given by the petitioner to Gulab Singh which is evident from copy of charge report at page no. 17.

In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Manigachhi P.S. Case No. 134 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
