The petitioner seeks regular bail in connection with Jai Nagar P.S. Case No. 589 of 2018 registered for the offence punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation is regarding recovery of 1080 litres of illicit Nepali liquor from the Pick Up van of the petitioner herein.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. There is no compliance of Section 100 Cr.P.C. while preparing the seizure list and the petitioner is stated to be having a clean antecedent and he is languishing in custody since 16.10.2018.

No.79408 of 2018(2) dt.11-01-2019 2/2 Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Iind Additional District and Session Judge-cum-Special Judge, Excise Act, Madhubani in connection with Jai Nagar P.S. Case No. 589 of 2018.
