The petitioners apprehend their arrest in connection with Angarh P. S. Case No. 40 of 2016 instituted under Sections 406, 409 and 420/34 of the Indian Penal Code. The allegation, in brief, is that the petitioners, being the Chairman and the Manger of the concerned PACS respectively, were required to procure the paddy from the farmers and to deposit the CMR, but the rice worth Rs. 5,74,000/- was not deposited.
It is submitted that the petitioners have already deposited Rs. 5,74,000/- along with interest in total 6,17,668/- and they have no criminal antecedent and only delay was made in depositing the amount even no show cause was earlier issued by
Patna High Court Cr.Misc. No.6509 of 2017 (2) dt.10-02-2017 2/2 the Department to the petitioners.
Having considered the aforesaid facts and circumstances, let the petitioners, named above, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VIth, Purnea in connection with Angar P.S.Case No. 40 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
