2. The petitioner seeks bail in connection with Jakkanpur PS Case No.134 of 2025 dated 19.02.2025, instituted for the offence punishable under Sections 80 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The prosecution case, in short, is that the deceased was married with the petitioner in the year 2023. The petitioner was working as Constable (Driver) in Bihar Police and was posted at Muzaffarpur. The deceased was staying in a rented accommodation at Patna. On the alleged date of occurrence, when the deceased's younger sister visited her house at Indira
Patna High Court CR. MISC. No.61274 of 2025(4) dt.10-12-2025 2/3 Nagar, she found the front door of the house was closed. Upon knocking the door, nobody opened the gate. Then, she noticed that the back door was opened through which she entered the house and saw the deceased, Prinyanka, hanging from ceiling fan. Upon crying by the sister of the deceased, the landlord and neighbours came there. The deceased was taken to nearby Nursing Home from where she was sent Maxo Hospital, but she was declared dead. The informant has suspected that his daughter has not committed suicide, rather, she has been killed. It is further alleged that his daughter was tortured by her mother-in-law, sister-in-law and other in-laws and the role of the petitioner is also suspicious.
4. Learned senior counsel for the petitioner submits that the petitioner is the husband of the deceased. The petitioner has been made accused only because he is the husband. It is admitted fact that the petitioner is employed in Bihar Police as Constable (Driver) and posted at Muzaffarpur and on the alleged date of occurrence he was on duty at Muzaffarpur. There was very cordial relation between the petitioner and the deceased. In fact, the petitioner has also purchased a land in Patna in the name of the deceased out of love and affection. The petitioner had taken a room on rent at Jakkanpur for staying of the
Patna High Court CR. MISC. No.61274 of 2025(4) dt.10-12-2025 3/3 deceased, who was pursuing Nursing Course at Patna as also for her betterment. There is no material available in the case diary to suggest the complicity of the petitioner in the crime. As per the FIR, the death occurred due to hanging. It is a pure case of suicide and the petitioner has no role in the said crime. Further, it would appear from the bank statements of the State Bank of India that the petitioner used to send money regularly to the deceased through Pay Phone for her education and other expenses which proves that there was cordial relation between them. Petitioner is in custody since 19.06.2025 having no criminal antecedents.
5. Learned APP as well as learned counsel for the informant has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-VIII, Patna, in Jakkanpur PS Case No.134 of 2025.
7. The application stands allowed.
