The petitioner apprehends his arrest in connection with Narari Kal Khurd P.S. Case No. 12 of 2016, registered under Sections 147, 149, 353, 386, 506 and 120(B) of the Indian Penal Code.
The accusation is that, on receiving information about making hindrance by labourers of "Andwell Company" at NPGCL, Navi Nagar and also surrendering the Incharge of
project, Sanjay Ram and K.M. Singh Constables of C.I.S.F., reached there and Sanjay Ram tried to take photograph while K.M. Singh gave information to C.I.S.F. Control Room. At that time, eight persons named in the F.I.R. including the petition gave threatening and approached towards Sanjay Ram and K.M. Singh with iron rod to cause assault to them. Learned counsel for the petitioner submits that while petitioner is named in the F.I.R. along with seven others but no specific overt act has been attributed against them. It is further submitted that similarly situated co-accused, Chandan Kumar, Dilip Gupta, Surendra Chaudhary and Arun Kumar, who are named in the F.I.R. along with petitioner, have already been granted privilege of anticipatory bail by this a Bench of this Court vide order dated 05.10.2016 passed in Criminal Misc. No. 40178 of 2016.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Narari Kal Khurd P.S. Case No.
12 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
