JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code.

It is alleged that the FIR named accused persons including the petitioner variously armed came to the land of the informant which was objected by the husband of the informant when the accused persons assaulted with lathi, fists and slaps to the husband of the informant who died on the spot. It is submitted by learned counsel for the petitioner that the postmortem report reflects no external and internal injury nor the doctor ascertained the cause of death and viscera has been preserved. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

No.1244 of 2015 (2) dt.13-01-2015 2/2 Considering the postmortem report which completely negates the accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Madhepura in connection with Kumarkhand (Bhatni O.P.) P.S. Case No. 132 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
