JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-01-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that the petitioners are the parents, brothers and co-villager of Bikram Kumar against whom it is alleged that he kidnapped the daughter of the informant.

In 164 Cr. P.C. statement, the victim got her age recorded as 13-14 years when the court also assessed as same where she stated that she of her own married with Bikram Kumar

Patna High Court Cr.Misc. No.1185 of 2015 (2) dt.13-01-2015 2/2 for which neither the parents of the victim nor the parents of Bikram Kumar were ready. The police after investigation did not sent up the petitioners for trial but differing with the same, cognizance has been taken. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Rosera, Samastipur in connection with Bithan P.S. Case No. 17 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
