Mr. GP-12 ====================================================== CORAM: HONOURABLE MR. JUSTICE P. B. BAJANTHRI ORAL JUDGMENT Date : 12-05-2022 Heard learned counsel for the respective parties. In the instant petition, petitioner has prayed for the following relief/reliefs:

"A) To issue a writ in the nature of writ of Mandamus commanding and directing respondents Authority to consider the case of petitioner for being appointed against the vacant and substantive post in regular establishment under Government of Bihar in terms of Annexure 8 of the writ application, as the petitioner is working against the contractual post of Lab Technician duly appointed vide Annexure 4 for more than 6 years.

The aforesaid relief is not supported by material information that petitioner has established statutory right before the competent authority in the form of application or representation. Therefore, petitioner is not entitled to the aforesaid relief.

Accordingly, the present petition stands dismissed, reserving liberty to the petitioner to approach the concerned authority in accordance with law.

At this stage, learned counsel for the petitioner seeks permission to withdraw the present petition. Accordingly, the present petition stands dismissed as withdrawn, reserving liberty to the petitioner to approach the concerned authority.
