The petitioner seeks bail in connection with Narayanpur P.S. Case No.63 of 2022 registered for the offence punishable under Sections 304B, 201, 120B and 34 of the Indian Penal Code.

Being father-in-law, the petitioner is accused of having taken part in the killing of the informant's daughter for non-fulfilment of demand for dowry.

Learned counsel for the petitioner submits that the petitioner was separate from his son and the victim and has been dragged in the prosecution by virtue of his relationship only. Several family members have been accused, though the prime

Patna High Court CR. MISC. No.60119 of 2022(2) dt.19-01-2023 2/3 responsibility of maintaining the honour and dignity of the deceased lies with the husband. The husband is in custody. Having no antecedents, the petitioner is in custody since 15.06.2022.

The learned APP for the State has opposed the prayer for bail.

Considering the rival submissions, nature of petitioner's relationship, period of custody since 15.06.2022, his clean antecedents and the fact that the investigation is complete, this Court for the purposes of grant of bail is inclined to accept the submissions advanced by the petitioner's counsel. Prayer for bail of the petitioner is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Bhojpur, Ara, in connection with Narayanpur P.S. Case No.63 of 2022, subject to the following conditions:

(i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
