Petitioners apprehend arrest in connection with Baikunthpur P.S. Case No. 278 of 2023 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Amendment Act.

Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case. Nothing has been recovered from the conscious possession of these petitioners. The alleged recovery has been made from a place near pond, which is an open place. Petitioners have no concern with the seized article.

No.67704 of 2023(2) dt.19-10-2023 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II-cum-Special Judge, Excise, Court No. I, Gopalganj in connection with Baikunthpur P.S. Case No. 278 of 2023 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
