====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 08-11-2023 Heard Mr. Avnish Kumar Singh, learned counsel appearing on behalf of the petitioners and Mr. Ganesh Prasad Singh, learned APP for the State.
2. The petitioners seek pre-arrest bail in connection with Chapra Muffasil P.S. Case No. 361 of 2023 registered for the offence punishable under Sections 341, 323, 353, 189, 504 and 506/34 of the Indian Penal Code.
3. Allegation is of assaulting and abusing the informant who is a Chaukidar of the village.

4. Learned counsel appearing on behalf of the petitioners submitted that petitioners are innocent and they have been implicated in a false case due to enmity with the chaukidar of the village. Petitioners have clean antecedent.
5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.
6. Considering the nature of allegation made in the F.I.R. as well as the fact that no specific allegation has been made against the petitioners and also in absence of any injury report that the informant has sustained any injury, the petitioners, above named, are directed to be released on prearrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 361 of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Purnendu Singh, J) mantreshwar/- U T
