JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-02-2023 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner has filed the instant application for grant of regular bail in connection with Mahila P.S. Case No. 12 of 2018 registered under sections 498(A), 312, 313, 315, 307 and 34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.
Prosecution case in short is that the informant was married with the petitioner and in her marriage, her father gave many ornaments, utensils, and household material and Rs. 7 lakhs as gift, but after some days all the accused persons including the petitioner started torturing, assaulting and demanding five lakhs from the informant.
Patna High Court CR. MISC. No.72632 of 2022(3) dt.24-02-2023 2/3 Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this present case. The petitioner is husband of the informant. It is further submitted that the petitioner is ready to keep his wife with honour and dignity which is mentioned in para- 8 of this petition. He has never demanded dowry nor he tortured her. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. He is languishing in judicial custody since 05.09.2022.
Learned counsel for the informant submits that victim is ready to live with the petitioner (husband). Petitioner has not cleared the dues as awarded to him by the Competent Court. Further, he is directed to pay due arrears in installment of Rs.10,000/- every month commencing from March, 2023.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Mahila P.S. Case No. 12 of 2018 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two
