JUSTICE SUDHIR SINGH ORAL ORDER 08-05-2015 The petitioner is apprehending his arrest in connection with Simri P.S. Case No. 198 of 2014 for the offence under Sections 420, 406, 409, 120B/34 of the Indian Penal Code.

Heard learned counsel for the petitioner and the State.

The prosecution story, in brief, is that the accused persons who are Mukhiya and Panchayat Secretary including the petitioner embezzled the Government money in purchasing solar light by violating the Government rules, directions as well as the prices and agency for supply of solar light and against the petitioner the allegation is also that he deliberately misplaced the documents.

It is submitted on behalf of the petitioner that petitioner is the retired Panchayat Sachiv and no irregularities

Patna High Court Cr.Misc. No.1231 of 2015 (3) dt.08-05-2015 has been committed on his behalf in respect to installation of solar lights, rather out of the political grudges the petitioner has been brought in the present case.

On behalf of the State, it has been submitted that the petitioner was Panchayat Sachiv and at the time of inspection he had not produced the documents in respect to the purchase of solar lights at the time of enquiry. Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Simri P.S. Case No. 198 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.

It has further directed that the petitioner shall deposit an amount of Rs. 8,000/- before the court below, which shall be subject to the final disposal of the case. (Sudhir Singh, J) P.K./- U T
