JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-03-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 272 and 273 of the Indian Penal Code and 30, 38 and 41 of the Bihar Excise Act, 2016. Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that name of the petitioner has come in course of investigation in the confessional statement of co-accused and no recovery is made from the possession of the petitioner.

Heard learned A.P.P. also.

Having heard both sides, in view of the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner, same is rejected.

However, petitioner is directed to surrender in the

Patna High Court Cr.Misc. No.8739 of 2017 (2) dt.01-03-2017 2/2 court below, i.e., learned A.C.J.M.-1, Samastipur, in connection with Tajpur P. S. Case no. 316 of 2016 and make prayer for regular bail on the basis of the above submission which shall be considered by the court below and pass an appropriate order preferably on the same day without being prejudiced by the order of this Court.

This application is accordingly disposed of.
