JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-12-2019 After some argument, the learned counsel for the petitioners seeks to withdraw the present petition, however, seeks a direction upon the learned court below to complete the trial within a stipulated time frame.
A bare perusal of the records of the case would show that this Court by an earlier order dated 01.08.2013, had directed the trial court to expedite the trial and conclude the same within a period of four months, however, despite lapse of about six years, no steps have been taken by the learned trial court to dispose off the pending trial.
Having regard to the facts and circumstances of the case,
Patna High Court CR. MISC. No.53389 of 2016(3) dt.09-12-2019 2/2 I deem it fit and proper to dispose off the present case as not pressed, however, with a direction to the learned court of Judicial Magistrate-1st Class, Arrah to dispose off the pending Complaint Case No. 10406(C) of 2008, Trial No. 790 of 2016, within a period of six months from today, failing which this Court would consider initiating departmental proceeding against the learned Judicial Magistrate-1st Class, Arrah. Let a copy of this order be communicated to the learned court below by the Registrar General of this Court for needful compliance as also with a direction to submit a report within a period of six months from today regarding completion of the trial.
