2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 191 (3) , 190, 126 ( 2 ), 115 ( 2 ), 109 (1) , 74, 303 ( 2 ) and 352 of the BNS.
3 . As per the prosecution case , informant namely ,
Patna High Court CR. MISC. No.60466 of 2025(2) dt.08-09-2025 2/3 Sarojini devi alleged that on 22.11.2024 at about 7 AM in the morning when informant was constructing her house , in the meantime , all the F.I.R. named accused persons including these petitioners came there and started abusing and assaulting her and in course of assault, petitioner No. 1 Triveni Sah assaulted on the head of informant with electric rod and petitioner No. 2 assaulted with iron rod.
4. Learned counsel for the petitioners submit that allegation of assault is general and omnibus against these petitioners. F.I.R. has been lodged after the delay of 4 days for which there is no plausible explanation . Doctor has found the injury simple in nature . Petitioners claim clean antecedent. 5 . Learned counsel for the State oppose the bail petition .
6. Considering the nature of injury , general and omnibus allegation of assault, clean antecedents of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate , 1st Class Rosera District- Samastipur in connection
Patna High Court CR. MISC. No.60466 of 2025(2) dt.08-09-2025 3/3 with Singhia P.S. Case No. 221 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
