JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner and the State. The petitioner is languishing in custody since 14/02/2014 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504, 447 and 506 of the Indian Penal Code and Section 27 of Arms Act.

It is alleged that the petitioner came to the house of the informant with gun and asked him to withdraw the earlier case filed by him. Thereafter associates of the petitioner assaulted the informant and informant's father. The associates of the petitioner resorted to firing.

It is submitted by learned counsel for the petitioner that no injury was caused to the informant side. It is further submitted

Patna High Court Cr.Misc. No.2630 of 2015 (2) dt.21-01-2015 that co accused Maya Singh @ Maya Shankar Singh has been granted bail vide order dated 05/11/2014 in Cr. Misc. No. 40194 of 2014.

Learned counsel for the State has submitted that the petitioner has criminal antecedent.

Considering the aforesaid facts, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikarahana at Motihari (East Champaran) in Madhuban P.S.Case No. 12/2013. The court below will be at liberty to cancel the bail bonds of the petitioner if he gets substantially involved in some serious nature of offence or defaults for two consecutive occasions.
