2. The petitioner has preferred this application for grant of regular bail in connection with Patna Rail P.S. Case No. 496 of 2023 dated 13.6.2023 registered for the offence punishable under Section 401 of the Indian Penal Code.

3. The allegation as per the First Information Report is that the informant was on duty on 13.6.2023 and during course of special checking he along with other Police personnel reached Platform Nos. 6 and 7 at Patna Junction, and saw five persons who were whispering

Patna High Court CR. MISC. No.63073 of 2023(2) dt.06-10-2023 2/3 making of circle and on seeing the Police Party, they tried to escape but were apprehended. They disclosed their names as Raja Kumar, Rakesh Yadav @ Popular (petitioner), Deepak Soni, Dileep Kumar Singh and Vinod Kumar Mahto. On search, blade, scissors and knives have been recovered from their conscious possessions and they told that they used the recovered articles to commit theft in trains at Patna Junction and adjacent railway stations.

4. Learned counsel for the petitioner has submitted that the petitioner has been arrested merely on suspicion. The petitioner has falsely been implicated in this case with oblique motive. He has further submitted that the petitioner is accused in two other criminal cases in which he is on bail and he has been acquitted in other case. The petitioner is in custody since 14.6.2023.

5. On the other hand, learned A.P.P. has vehemently opposed the prayer for bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, the period of custody as well as the nature of allegation, the petitioner above named is directed to be released on bail on his furnishing bail bond of

Patna High Court CR. MISC. No.63073 of 2023(2) dt.06-10-2023 3/3 Rs. 20,000/- (Twenty thousand), with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Patna, in connection with Patna Rail P.S. Case No. 496 of 2023.
