JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-04-2024 The present writ petition has been filed seeking the following relief:- "(i) For issuance of writ in the appropriate nature for quashing of the order dated 17.11.2020 issued under the signature of the Respondent No. 2 whereby and where under engagement of the petitioner to the post of City Urban Finance Consultant has been cancelled with immediate effect without making payment of due remuneration and without considering the show cause as well as without giving opportunity of hearing on the show cause.

(ii) For further direction to the Respondent No. 1 to expedite the hearing of appeal filed against the order

Patna High Court CWJC No.21227 of 2021(2) dt.10-04-2024 2/3 dated 17.11.2020 which is still pending since long and no final order has been passed.

(iii) For further direction to the Respondents authority to re-engage the petitioner on the post of City Urban Finance Consultant and after giving opportunity of personal hearing to the petitioner pass an appropriate order in accordance with law.

(iv) For further direction to the Respondents authority to pay the due salary of the petitioner of 47 days." 2.

At the outset, the learned counsel for the petitioner seeks a direction upon the appellate authority, i.e. the Principal Secretary, Department of Health, Govt. of Bihar, Patna, to dispose off the appeal filed by the petitioner on 16.04.2021, against the order dated 07.11.2020, passed by the Executive Director, State Health Society, Bihar. 3.

The learned counsel appearing for the respondent submits that in case the aforesaid appeal is still pending, the same would definitely be disposed off, within a stipulated time frame.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the appellate authority to dispose off the aforesaid appeal, filed by the petitioner, in case the same has not yet been disposed off, by passing a reasoned and a speaking order, in accordance with

Patna High Court CWJC No.21227 of 2021(2) dt.10-04-2024 3/3 law, within a period of six weeks of receipt/production of a copy of this order.

The writ petition stands disposed off on the aforesaid term.
