====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 18-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bahadurganj P.S. Case No. 212 of 2018 instituted for the offence under Sections 302, 201 and 392/34 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is not named in the written report. The name of petitioner has come in the confessional statement of co-accused Md. Akbar. It is alleged in the written report that husband of the informant had gone along with Akbar to Gulabbag Purnea for purchasing some articles as mentioned in the written report. The informant got information on next day that dead body of her husband is lying between Birnia and Patimil in the water. Co-accused Akbar during investigation has taken name of this petitioner in his confessional statement before the police.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Bahadurganj P.S.
