JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-03-2017 The petitioner is apprehending his arrest in connection with Baikunthpur P.S. Case No. 84 of 2016, registered for offences punishable under Sections 467, 468, 420 and 120(B) of the Indian Penal Code.
It has been submitted on behalf of the petitioner that a case under Section The Clinical Establishments (Registration and Regulation ) Act has been filed against the petitioner, however, the petitioner is neither a doctor nor he runs any clinic. It has further been submitted that he has falsely been implicated in this case at the instance of Mukhia and the persons who are alleged to have been operated, they have already filed affidavit to that effect. Heard learned A.P.P. also.
Having heard both sides, in view of the submission of
Patna High Court Cr.Misc. No.10121 of 2017 (3) dt.21-03-2017 2/2 learned counsel for the petitioner, let petitioner surrender before the Court below and the court below after examining the above submission of learned counsel for the petitioner, shall pass an appropriate order, if possible, on the same day, without being prejudiced by the order of this Court.
