Petitioners apprehend their arrest in Akbarpur P.S. Case No.265 of 2019 registered under Sections 341, 323, 379, 354, 448, 504 and 34 of the Indian Penal Code. The informant alleged that Shankar Prasad (petitioner no.1) came to her house singing a song and touched her hand with bad intention. When she raised alarm, the mother-in-law of the informant came to save her. It is further alleged that after sometime all accused persons came and assaulted the informant and others.

Learned counsel for the petitioners submits that petitioner no.1 also filed Akbarpur P.S. Case No.264 of 2019.

Patna High Court CR. MISC. No.57177 of 2019(2) dt.16-09-2019 2/2 Ramanand Prasad (husband of the informant Kanchan Devi) was taking photographs of the daughter of petitioner no.1 and he was also stalking her. On protest, the accused persons assaulted petitioner no.1 and his family members. It appears that both sides made allegation against each other and the petitioners and the informant are neighbour.

Having considered the facts and the nature of allegation made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Nawada in connection with Akbarpur P.S. Case No.265 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
