The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016. Submission is that recovery of liquor is alleged from the house of some other persons and they disclosed that coaccused Nitish Kumar was involved in sale and purchase of the liquor at a belated stage of the investigation and some one stated to the police that the petitioners were also involved in the same business.

Considering the fact that there is no direct material

Patna High Court CR. MISC. No.79699 of 2019(3) dt.10-12-2019 2/2 against the petitioners and also considering that the petitioners have got clean antecedent, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender in the court below within a period of thirty days from the date of receipt of the order, on furnishing bail bond of Rs.20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna in connection with Barh P.S.Case No.346 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
