The petitioners apprehend their arrest in Chenari P.S. Case No. 184 of 2016 registered for the offences punishable under Sections 385, 386 and other Sections of the Indian Penal Code. The informant alleged that he purchased 81⁄2 acres of land situated in village Lohara through a registered sale deed. On 20.08.2016 the informant went to the field for cultivation the petitioners and others having armed with firearms came and demanded extortion for allowing the field to be cultivated. Learned counsel for the petitioners submits that Kashmiriya Devi, wife of Sita Ram Bind has purchased 12 decimals of land in the year 1985 of Plot No. 694, Khata No. 89 from Ekbal Khan and Sita Ram Bind and others were in peaceful
Patna High Court Cr.Misc. No.11302 of 2017 (2) dt.04-04-2017 2/2 possession but the informant purchased the entire land of the aforesaid plot and in order to dispossess the petitioners this false case has been lodged.
Considering the facts aforesaid and nature of allegations made against the petitioners and the fact there appears bona fide land dispute, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Sasaram, Rohtas in Chenari P.S. Case No. 184 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
