====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Ghoghardiha P.S. Case No. 131 of 2015 (Sessions Trial No. 30 of 2018), instituted for the offence under Sections 302, 201 and 120(B) of the Indian Penal Code.
It is alleged in the written report that informant received message that one dead body of female is lying at Bahiyar near Parsa-Basuari. Thereafter, he went there and informed the police and after that the police reached at the place of occurrence and lodged the instant case against unknown.
From the impugned order, it appears that petitioner has been made accused in the instant case merely on suspicion
Patna High Court Cr.Misc. No.1902 of 2019(2) dt.15-01-2019 2/2 because he is husband of sister of the deceased. Counsel for the petitioner submits that petitioner is in custody since 24.7.2017 merely on suspicion. He has no criminal antecedent. The First Information Report is against unknown. Counsel for the petitioner further submits that coaccused Jitan Mandal has already been granted bail by coordinate Bench of this Court vide order dated 27.9.2016 passed in Cr. Misc. 32109 of 2016.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI, Madhubani, in connection with Ghoghardiha P.S. Case No. 131 of 2015 (Sessions Trial No. 30 of 2018), subject to the condition that both the bailors will be the close relatives of the petitioner.
