The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 420, 467, 468, 471, 120(B) of the Indian Penal Code.

Prosecution case relates to commission of forgery by the petitioner, in the examination process of Selection of constable in S.S.B.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. The name of

Patna High Court CR. MISC. No.61972 of 2022(2) dt.09-02-2023 2/3 the petitioner has transpired in this case on confessional statement of co-accused, Deepak Kumar. There is general and omnibus allegation against the petitioner and there is no specific allegation attributed against him. Moreover, petitioner suo-moto surrendered on 21.06.2022 and since then he is languishing in judicial custody. It is also submitted that similarly situated coaccused person has been granted Bail vide order dated 25.09.2020, passed in Cr. Misc. No. 24832 of 2020 by the co-ordinate Bench of this Court. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection
