The petitioner apprehends his arrest in Goraul P.S. Case No. 85 of 2016 instituted for the offence under Section(s) 376, 341, 323, 504, 120B of the Indian Penal Code. There is allegation against this petitioner of establishing physical relationship with the informant on several occasions on the pretext of marrying her. He also put Sindur on her forehead and thereafter also established physical relationship with her. It is further alleged that when the informant came to the house of the petitioner, she was assaulted and the family members of the petitioner did not become ready to accept her as daughterin-law and she was ousted after assault.
Patna High Court Cr.Misc. No.6140 of 2017 (2) dt.20-02-2017 2/2 Learned Sessions Judge has mentioned in the order that several opportunities were given by the lower court to compromise the matter but no settlement could be reached. In such circumstance, keeping in view the direct and serious allegation against the petitioner, this Court is not inclined to enlarge the petitioner on anticipatory bail. The prayer of the petitioners for anticipatory bail is rejected. The petitioner is directed to surrender before the Court below within a period of six weeks from today in connection with Goraul P.S. Case No. 85 of 2016 and seek regular bail, which shall be considered and disposed off on its own merit without being prejudiced by the order of this Court. (Sanjay Priya, J) Shageer/- U T
